By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any additional terms and policies referenced herein, including our Privacy Policy. If you do not agree, please do not use the Website.

1. Eligibility & Acceptance of Terms

By using the Website, you represent and warrant that:

  1. You are at least 18 years of age, or the age of majority in your jurisdiction; and

  2. You have the legal capacity to enter into a binding contract with EMK Skincare.

Your access to and use of the Website constitutes your acceptance of these Terms.

2. Intellectual Property

All content on the Website—including, but not limited to, text, graphics, logos, images, product names, videos, audio clips, button icons, page layouts, software, and the selection and arrangement thereof—is owned by EMK Products, LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.

  1. The compilation (meaning the collection, arrangement, and assembly) of all content on the Website is the exclusive property of EMK Skincare.

  2. All software used on the Website is the property of EMK Skincare or its software suppliers and is likewise protected.

You are granted a limited, revocable license to electronically copy and print portions of the Website solely for the purpose of placing an order with EMK Skincare or for your personal, non-commercial use.

Any other use—including reproduction for purposes other than those permitted above, modification, distribution, republication, transmission, display, performance, or creation of derivative works—without EMK Skincare’s prior written consent is strictly prohibited.

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

  2. Attempt to gain unauthorized access to any systems, networks, or data;

  4. Use the Website in a way that could damage, disable, overburden, or impair our servers or networks.

We reserve the right to terminate or restrict your access to the Website for any violation of these Terms.

6. Online Purchases & Account Responsibility

When you make a purchase through the Website, you agree to:

  1. Provide accurate, current, and complete information;

  2. Maintain the confidentiality of your account login and password; and

  3. Accept responsibility for all activities that occur under your account.

We reserve the right to refuse, limit, or cancel any order at our sole discretion, including but not limited to orders that appear to be placed by resellers or distributors.

7. Third-Party Websites & Services

The Website may contain links to or integrations with third-party websites, services, or technologies that are not owned or controlled by EMK Skincare (“Third-Party Services”).

We do not endorse and are not responsible for:

  1. The content, privacy practices, or security of Third-Party Services; or

  2. Any loss or damage arising from your use of them.

You access Third-Party Services at your own risk and should review their terms and privacy policies.

8. Shipping & Delivery

Standard Shipping

  1. FREE standard shipping (5–7 business days, reduced carbon emissions) within the United States on orders over $100 USD.

  2. FREE shipping to Canada for orders over $200 USD.

  3. FREE shipping to Mexico for orders over $200 USD.

  4. FREE shipping to Asia, Oceania, and the Middle East for orders over $500 USD.

  5. FREE worldwide shipping to all other destinations for orders over $275 USD.

Processing Time

  1. Warehouse processing time is typically 24–48 hours and is not included in shipping estimates.

  2. Orders are not processed on weekends or holidays.

Carrier Responsibility

Once an order is transferred to the shipping carrier, it becomes subject to the carrier’s processes and policies. EMK Skincare:

  1. Does not control carrier delivery practices;

  2. Is not responsible for misdelivered orders by the carrier.

If tracking indicates “delivered” and you have not received your package, you must first contact the carrier. If the issue remains unresolved, contact EMK Customer Care at hello@emkskincare.com with details of your communications with the carrier.

Customers are responsible for filing any claims with carriers for misdelivered orders. EMK Skincare does not issue refunds for misdelivered orders.

9. Pre-Order Products, Out-of-Stock Items & Partial Shipments

If an item is in pre-order status or becomes out of stock after purchase:

  1. EMK Skincare will cover the cost of shipping that item separately once it becomes available.

  2. For international orders, any previously paid duties and taxes for the affected product(s) will be honored upon shipment.

If you wish to add items at the time of shipment:

  1. You will be responsible for any additional shipping fees and applicable duties/taxes for those added items.

All shipping costs, duties, and taxes for the original order are charged at the time of purchase and are non-refundable once the order has been processed.

10. Returns

All returns must follow EMK Skincare’s designated return procedure.

Return Portal Required

  1. Customers must initiate returns through our official Return Portal: [EMK Skincare Returns] (link).

  2. Returns not processed through the portal may be subject to delays or tracking issues, for which EMK is not responsible.

Unauthorized Returns & Refused Deliveries

If you refuse delivery or return an order using an alternative method outside of our return portal:

  1. A $25 restocking fee will be assessed.

  2. You are responsible for ensuring the package arrives at our facility; EMK is not liable for lost or misrouted unauthorized returns.

If EMK is able to locate an unauthorized return, it will be subject to the following:

  1. Returns must be received within 30 days of the original delivery date.

  2. Returns received after 30 days are not eligible for a refund or store credit.

We strongly encourage use of our return portal for full tracking and confirmation.

11. Promotions, Discount Codes & Quiz/Tool-Based Rewards

From time to time, EMK Skincare may offer promotions, discount codes, or other incentives (“Offers”). Unless otherwise stated:

  1. Offers are valid only for orders placed on emkskincare.com.

  2. Offers cannot be combined with other promotions, loyalty redemptions, wholesale discounts, or subscription pricing.

  3. Offers are not valid on gift cards, taxes, shipping, processing charges, or prior purchases.

  4. Offers apply only to in-stock items and are subject to change or cancellation at any time.

Eligibility & Limitations

  1. Offers are non-transferable and may be limited to the addressed or intended recipient.

  2. Items placed in your shopping bag are not reserved until checkout is successfully completed.

  3. We reserve the right to cancel any order due to unauthorized, altered, or ineligible use of an Offer.

Rewards Linked to Online Tools

From time to time, EMK may offer rewards or discount codes in connection with online tools available on the Website (for example, digital assessments or interactive experiences).

Unless otherwise specified:

  1. Rewards issued in connection with such tools are limited to one (1) eligible reward per customer in any rolling 90-day period.

  2. You may use the tools multiple times, but you will only receive one applicable reward code in that 90-day period.

  3. All such codes are single-use, non-transferable, and subject to these Terms.

12. Limitation of Liability

To the fullest extent permitted by law, EMK Products, LLC and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to:

  1. Your access to or use of the Website;

  2. Any products purchased through the Website;

  3. Any errors or omissions in content; or

  4. Any damage to your computer system or loss of data.

Where liability cannot be excluded under applicable law, our total liability shall be limited to the amount you paid for the products or services giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless EMK Products, LLC, its directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  1. Your use of the Website;

  2. Your violation of these Terms; or

  3. Your infringement of any third party’s rights.

14. Modifications to Terms

We may update or modify these Terms from time to time. Any changes will be effective upon posting on the Website with an updated “Last Updated” date.

Your continued use of the Website following such changes constitutes your acceptance of the revised Terms.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of such courts.
